RIGHTS YOU ARE GIVING VOGUEVIE TO USE MATERIAL YOU UPLOAD

When you upload or post content to the Site, you grant VOGUEVIE a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform such content for any purpose across all media whether now known or hereinafter invented.

VIRUSES

VOGUEVIE does not guarantee that the Site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software.

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. APPLICABLE LAW

These terms and conditions shall be governed by and construed in accordance with the Indian Laws. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of India.

VOGUEVIE owns a number of trademarks in numerous territories, and use of such trademarks without prior written consent of VOGUEVIE would violate VOGUEVIE’s intellectual property rights.

INTERACTIVE SERVICES

We may from time to time provide interactive services on the Site, including, without limitation:

comment facilities; and

CONTENT STANDARDS

VOGUEVIE will determine, in its discretion, whether a Contribution breaches the Content Standards.

Contributions must:

be accurate (where it states states facts);
be genuinely held (where it states opinions); and
comply with the law applicable in England and Wales and in any country from which it is posted.

Contributions must not:

contain any material which is defamatory to any person;
contain any material which is obscene, offensive, hateful or inflammatory;
contain any material which bullies or may cause insult to any person;
contain any material which may intimidate or humiliate any person;
promote sexually explicit material;
promote violence;
promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
infringe any copyright, database right or trade mark of any other person;
be likely to deceive any person;
be made in breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
promote any illegal activity;
be in contempt of court;
be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
be likely to harass, upset, embarrass, alarm or annoy any other person;
be used to impersonate any person, or misrepresent your identity or affiliation with any person;
give the impression that the Contribution emanates from VOGUEVIE, if this is not the case; or
advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.

SUSPENSION AND TERMINATION

VOGUEVIE will determine, in its sole discretion, whether there has been a breach of this Acceptable Use Policy through your use of the Site. When a breach of this Acceptable Use Policy has occurred, VOGUEVIE may take such action as it deems appropriate.

Failure to comply with this Acceptable Use Policy constitutes a material breach of the Terms and Conditions upon which you are permitted to use the Site, and may result in VOGUEVIE taking all or any of the following actions:

immediate, temporary or permanent withdrawal of your right to use the Site;
immediate, temporary or permanent removal of any Contribution uploaded by you to the Site;
issue of a warning to you;
legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
further legal action against you; and/or
disclosure of such information to law enforcement authorities as VOGUEVIE reasonably feel is necessary or as required by law.

VOGUEVIE excludes liability for all action taken in response to breaches of this Acceptable Use Policy. The actions VOGUEVIE may take are not limited to those described above, and VOGUEVIE may take any other action deemed reasonably appropriate.

VOGUEVIE may revise this Acceptable Use Policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes made, as they are legally binding on you. Some of the provisions contained in this Acceptable Use Policy may also be superseded by provisions or notices published elsewhere on the Site.
